
Former Brazilian President Jair Bolsonaro has exhausted all remaining legal avenues to challenge the conviction issued against him for attempting to overturn the 2022 election results. In a ruling announced on Tuesday, the Supreme Court confirmed that the 27-year prison sentence is now final, after Bolsonaro’s legal team formally waived their right to file any further appeals. With that decision, the former president must serve the full term.
The announcement comes after days of uncertainty regarding where the 70-year-old ex-leader would be held. The Supreme Court had already rejected his initial appeal, and the withdrawal of additional challenges automatically cemented the conviction. According to the court, Bolsonaro led a criminal organization aimed at invalidating his electoral defeat to current president Luiz Inácio Lula da Silva.
The ruling found that his influence played a decisive role in the violent events of January 8, 2023, when hundreds of his supporters stormed the Supreme Court, the presidential palace, and Congress in Brasília—scenes widely compared to the January 6 Capitol riot in the United States. Bolsonaro’s legal situation deteriorated even further this past Saturday, when he was arrested for intentionally violating the terms of his house arrest.
Supreme Court Justice Alexandre de Moraes stated that Bolsonaro deliberately used a soldering tool to damage his electronic ankle monitor, an act interpreted as an attempt to evade state supervision. Prosecutors also reported “serious indications” that he may have been preparing to flee toward the nearby U.S. Embassy from the residence where he was confined.
Authorities argue that the suspicious movements, combined with Bolsonaro’s close ties to U.S. political figures, strengthened the possibility of an attempted escape or a future request for asylum. For that reason, the Supreme Court ordered his immediate transfer to a prison facility, where he will now remain to serve the entirety of his sentence.
